Terms of Service

These Terms of Service govern your use of Gotcha, an app for capturing animals, saving animal cards, building a personal animal collection, and viewing sightings on a map.

1. Acceptance

By using Gotcha, you agree to these Terms. If you do not agree, do not use the app.

2. Your Account

You may need to sign in with Apple to save your collection, sync your data, use paid features, or restore access. You are responsible for keeping access to your Apple ID secure and for all activity on your account.

3. App Purpose

Gotcha is designed for personal animal discovery, collection, and entertainment. The app may use automated image processing and classification to suggest animal identities, but results may be inaccurate or incomplete. Gotcha is not a scientific, veterinary, medical, safety, or emergency tool.

4. Safe and Responsible Use

You agree not to use Gotcha in a way that is unsafe, illegal, harmful, or abusive. Do not trespass, disturb wildlife, endanger yourself or others, or violate local rules while trying to photograph animals.

5. User Content

You may upload photos and related animal sighting information. You keep ownership of your content, but you give us a limited license to host, process, store, display, resize, analyze, and transmit that content as needed to operate Gotcha and provide its features.

You must only upload content you have the right to use. You must not upload illegal content, content that violates another person's rights, or content that includes private information you do not have permission to share.

6. Subscriptions and Paid Access

Gotcha may offer paid access through auto-renewable subscriptions purchased through the Apple App Store. Subscription details, including price, billing period, free trial duration, and renewal terms, will be shown before purchase.

Full access to paid Gotcha features is available only while your subscription is active, unless we provide a free trial or another limited access option. When your subscription ends, expires, is cancelled, or cannot be renewed, you may lose access to paid features, including full collection access, maps, sync, advanced cards, or other Plus features.

Subscriptions are managed by Apple. You can manage or cancel your subscription in your Apple ID settings. Unless cancelled before the end of the current period, subscriptions may renew automatically according to Apple's App Store terms.

7. Free Trials

If a free trial is offered, the app will show the trial duration and the price that applies after the trial ends. You may need to cancel before the trial ends to avoid being charged. Trial availability and terms may vary.

8. Inactive Subscription Data Retention

If your account does not have an active subscription, your access to paid features may be limited or disabled. However, your saved animals, photos, sighting history, map data, and collection statistics may be retained for up to 365 days so you can restore access if you subscribe again.

After 365 days without an active subscription, we may delete, archive, or anonymize some or all of your saved collection data. We are not required to keep inactive subscription data forever.

9. Payments and Refunds

Payments are processed by Apple. We do not receive or store your full payment card details. Refund requests are handled by Apple according to Apple's policies, unless applicable law requires otherwise.

10. Account Deletion

You may request account deletion from inside the app. Deletion may be scheduled with a short waiting period so you can cancel accidental requests. After deletion is completed, your account and related data will be deleted or anonymized, except where limited retention is required for legal, security, accounting, or fraud-prevention reasons.

11. Availability and Changes

We may change, suspend, or discontinue parts of Gotcha at any time. We may update animal catalogs, features, subscription offerings, or app behavior. We will try to avoid unnecessary disruption, but we do not guarantee that every feature will always be available.

12. No Warranty

Gotcha is provided "as is" and "as available." We do not guarantee that the app will be uninterrupted, error-free, perfectly accurate, or always available.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from your use of Gotcha.

14. Apple

Apple is not responsible for Gotcha or its content. Apple has no obligation to provide maintenance or support for Gotcha. Your use of the app may also be subject to Apple's App Store terms and Apple Media Services terms.

15. Termination

We may suspend or terminate access if you violate these Terms, misuse the service, create security risk, or use the app in a harmful or illegal way.

16. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you. Continued use of Gotcha after changes means you accept the updated Terms.
