These Terms of Use (“Terms”) govern your access to and use of the Draw AI: AR Drawing How to Draw Sketch mobile application (“Draw AI”, “App”, “Service”), operated by Artem, an individual entrepreneur registered in Georgia (“Company”, “we”, “us”, or “our”).
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
By using the App, you confirm that:
The App is not intended for children under 13. If you are under 13, you must not use the App. If you are between 13 and 18, you may use the App only with consent of a parent or legal guardian.
Draw AI offers premium features through auto-renewing subscriptions billed via the app store where you downloaded the App (Apple App Store and/or Google Play). Subscriptions are managed exclusively by the relevant app store.

Some subscription plans may include a 3-day free trial, as displayed by the app store at the time of purchase. During the free trial period, subscription Tokens are not granted. Tokens are granted only during a paid subscription period.
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Renewal is charged to the same app store account used for the initial purchase.
You can manage or cancel your subscription in your Apple ID or Google account settings. We cannot manage or cancel subscriptions on your behalf.
Payments and refunds are handled solely by the app store (Apple/Google) under their policies. The Company does not process refunds directly and is not responsible for refund decisions made by the app store.
In addition to subscriptions, the App offers one-time purchases of Token packs that allow you to access AI Features and certain tools.

Purchases are generally tied to your app store account and, in some cases, to an internal device identifier. We may provide restore tools, but we do not guarantee that all Tokens or history will be fully restored in every scenario. To the maximum extent permitted by law, we are not liable for loss of Tokens due to technical failures, server issues, or data corruption.
You may upload photos/images and provide prompts to generate step-by-step drawing tutorials. You retain ownership of your User Content.
By uploading User Content, you represent and warrant that:
The App generates outputs based on your inputs (“Generated Content”). As between you and us, you own the rights (if any) to Generated Content permitted by applicable law. You are solely responsible for how you use Generated Content.
To operate, maintain, improve, and develop the App (including improving and training AI systems used by the Service), you grant the Company a worldwide, non-exclusive, royalty-free, fully paid, sublicensable and transferable license to:
If applicable law requires consent for certain training uses, we will obtain it through in-app notices or settings, or provide a lawful alternative.
AI Features may produce unexpected, low-quality, inaccurate, incomplete, or unsuitable results. We do not guarantee that Generated Content will be accurate, consistent, or fit for your purpose. You use AI Features at your own risk.

All Content in the App (excluding your User Content and Generated Content) is owned by the Company or its licensors and protected by intellectual property laws. You may use the App only for personal, non-commercial use.
The App is provided on an “as is” and “as available” basis without warranties of any kind. We do not guarantee uninterrupted availability, error-free operation, or that Generated Content will meet your expectations.
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of Tokens, loss of revenue, or service interruptions.
In all cases, our total liability for any claim relating to the App is limited to the amount you paid for the App or subscriptions through the relevant app store in the twelve (12) months preceding the claim (excluding any amounts retained by the app store), or 0 if you paid nothing.
We make reasonable efforts to keep the App and your data available and secure, but we cannot guarantee that data (including User Content, Generated Content, and Token balances) will never be lost, corrupted, or deleted due to technical issues, server failures, or other events.
We may suspend or terminate access to the App at any time if you violate these Terms, we are required to do so by law, or we decide to discontinue the App. Upon termination, we are not obligated to provide refunds for unused Tokens or remaining subscription time unless required by law or app store policy.
We may update these Terms from time to time. If we make material changes, we will notify you within the App or via the app store listing. Continued use after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of Georgia, without regard to conflict of law provisions. Where permitted by law, disputes shall be subject to the exclusive jurisdiction of the competent courts of Georgia.
