Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the EasyBuild mobile application (“EasyBuild”, “App”, “Application”, “Service”), operated by Artem, an individual entrepreneur registered in Georgia (“Company”, “we”, “us”, or “our”).

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Definitions

For the purposes of these Terms:

• Application / App / Service means the EasyBuild mobile application available on the Apple App Store and/or Google Play Store.
• Company means Artem, an individual entrepreneur operating under the laws of Georgia.
• User (“you”) means any individual who downloads, accesses, or uses the App.
• Device means any device capable of running the App (for example, a phone or tablet).
• Subscription means an ongoing paid access plan to premium features of the App.
• Tokens means virtual credits used inside the App to access AI features and other tools.
• AI Features means features such as “Build AI”, “Art AI” or similar tools that generate or transform images using artificial intelligence based on your input (photos, screenshots, prompts, etc.).
• User Content means any content, including images, screenshots, photos, prompts, text, and other materials that you upload or submit to the App.
• Generated Content means images, assets, or other outputs produced by the App (including by AI Features) based on your User Content or prompts.
• Content means all materials available in the App, including but not limited to guides, images, UI, text, code, designs, and any other materials.

2. Acceptance of Terms

By using the App, you confirm that:

• You have read, understood, and agree to these Terms;
• You are legally capable of entering into a binding agreement under the laws of your country of residence;
• If you are under 18, you have permission from a parent or legal guardian to use the App.

3. Age and Content Rating

The App may be listed with a content rating such as “4+” in the app store. This is an app store content classification only and does not override applicable law.

The App is not intended for children under 13 years of age. If you are under 13, you must not use the App. If you are between 13 and 18, you may only use the App with the consent of a parent or legal guardian.

4. Subscriptions and Payments

EasyBuild offers premium features through recurring subscriptions, which are billed via the app store where you downloaded the App (Apple App Store and/or Google Play Store). Subscriptions are managed exclusively by the relevant app store.

4.1 Available Subscription Plans

Current subscription plans include (names and prices may vary by region and currency):

• Weekly Pass – 1 week – approximately 4.99 USD;
• Yearly Pass – 1 year – approximately 14.99 USD.

The exact price and currency are shown on the purchase screen in the app store.

4.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. The renewal is charged to the same app store account used for the initial purchase.

4.3 Managing and Cancelling Subscriptions

You can manage or cancel your subscription at any time in your app store account settings (Apple ID or Google account settings). We do not have access to your app store billing account and cannot manage or cancel subscriptions on your behalf.

4.4 Refunds

All payments and refunds for subscriptions are handled solely by the app store (Apple or Google), according to their policies. The Company does not process refunds directly and is not responsible for refund decisions made by the app store.

5. Tokens and In-App Purchases

In addition to subscriptions, the App offers one-time purchases of Token packs that allow you to access AI Features and certain tools.

5.1 Token Packs

Token packs may include, for example:

• Small Token Pack – approximately 3.99 USD;
• Medium Token Pack – approximately 9.99 USD;
• Mega Token Pack – approximately 24.99 USD.

Exact prices and token amounts are shown in the App at the time of purchase.

5.2 Nature of Tokens

• Tokens are virtual credits with no real-world monetary value.
• Tokens are non-refundable, non-transferable, and cannot be exchanged for cash or any other currency.
• We may change how Tokens can be used, their cost in real currency, or the amount of Tokens needed to use certain features at any time.

5.3 Subscription Tokens vs. Purchased Tokens

• Some Tokens may be granted as part of a Subscription (for example, a certain number of Tokens per week or month).
• Subscription Tokens: Tokens granted as part of a Subscription are provided for the current billing period only and expire when the Subscription renews or ends. Unused Subscription Tokens do not roll over to the next billing period and are automatically reset when a new subscription period begins.
• Purchased Token Packs: Tokens bought as one-time purchases (Token packs) are intended to remain available on your account for as long as your account exists, but may be lost in case of technical issues, data loss, or if your account is deleted or reset.

5.4 Transfer, Restore, and Device Changes

Purchases are generally tied to your app store account and, in some cases, to a specific device or internal identifier.

• We may provide tools to restore purchases and Tokens when you reinstall the App or change devices, but we cannot guarantee that all Tokens (including Token packs and Subscription Tokens) or history will be fully restored.
• It is your responsibility to use the same app store account and follow all restore instructions within the App.
• In the event of technical failures, server issues, or data corruption, some or all of your Tokens may be lost. To the maximum extent permitted by law, the Company is not liable for such loss.

6. AI Features, User Content and Generated Content

6.1 User Content

You may upload or submit User Content to the App, including images, screenshots, prompts, and other materials (for example, screenshots of your Minecraft builds). You retain ownership of your User Content.

By uploading User Content, you represent and warrant that:

• You own the User Content or have all necessary rights and permissions to use it and to grant the licenses described in these Terms;
• Your User Content does not infringe any third-party rights (including copyright, trademark, privacy, or other rights);
• Your User Content does not violate any applicable laws or these Terms.

6.2 Generated Content and Ownership

When you use AI Features (for example, Build AI or Art AI), the App generates images or other outputs based on your User Content or prompts (“Generated Content”).

• As between you and us, you own the rights (if any) to the Generated Content permitted by applicable law.
• You are solely responsible for how you use the Generated Content, including any use outside the App.
• You are responsible for ensuring that your use of Generated Content does not violate any laws, third-party rights, or policies (including Mojang/Microsoft policies for Minecraft).

6.3 License to the Company (In-App Use)

To operate and improve the App, you grant us a limited license to your User Content and Generated Content.

Specifically, you grant the Company a worldwide, non-exclusive, royalty-free, fully paid, sublicensable and transferable license to:

• host, store, reproduce, display, and adapt your User Content and Generated Content within the App and its related services only (for example, your profile, history, previews, AI galleries, in-app showcases);
• use such content to operate, maintain, and improve EasyBuild and its AI Features.

We will not use your User Content or Generated Content for external marketing or promotion outside the App (such as external advertising, websites, or social media) without your additional explicit consent.

6.4 AI Limitations and Responsibility

AI Features may sometimes produce unexpected, low-quality, or incorrect results. The App does not guarantee that any Generated Content will be accurate, suitable for your purpose, or available at all times. You use AI Features at your own risk.

You agree that:

• You will not use AI Features to create illegal, harmful, or abusive content;
• You will not use AI Features to infringe intellectual property or privacy rights;
• The Company is not responsible for any consequences of your use of Generated Content.

6.5 Minecraft Disclaimer

EasyBuild is an independent application and is not an official Minecraft product. It is not approved by or associated with Mojang AB, Microsoft, or any of their affiliates. All Minecraft-related names, brands, and assets are the property of their respective owners.

7. Prohibited Uses

You agree not to use the App:

• for any unlawful purpose or in violation of any applicable law or regulation;
• to upload or generate content that is illegal, defamatory, hateful, harassing, or otherwise harmful;
• to infringe any intellectual property, privacy, or other rights of third parties;
• to attempt to reverse-engineer, decompile, or otherwise extract the source code of the App;
• to interfere with or disrupt the App, servers, or networks;
• to circumvent any technical protection measures or usage limits;
• to attempt to gain unauthorized access to any accounts, systems, or data.

8. Intellectual Property

All Content in the App (excluding your User Content and Generated Content), including but not limited to guides, images, UI, code, logos, designs, and text, is the intellectual property of the Company or its licensors.

You may use the App and its Content only for your personal, non-commercial use and only as permitted by these Terms. You may not copy, reproduce, redistribute, modify, or create derivative works from the App or its Content for commercial or public purposes without our prior written consent.

9. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. We do not guarantee that:

• the App will be error-free or uninterrupted;
• defects will be corrected;
• the App will always be available or compatible with your Device;
• any Generated Content will be accurate, reliable, or suitable for any particular purpose.

To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, the Company, its owner, and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• loss of data or content (including User Content, Generated Content, or Tokens);
• loss of profits or revenue;
• service interruptions or loss of access to the App;
• any damages arising out of your use of or inability to use the App.

In all cases, the total liability of the Company for any claim relating to the App shall be limited to the amount you paid for the App or, where the App is free, to the subscription fees you paid to us through the relevant app store in the twelve (12) months preceding the claim (excluding any amounts retained by the app store).

11. Data, Storage, and Technical Issues

We make reasonable efforts to keep the App and your data available and secure, but we cannot guarantee that your data (including User Content, Generated Content, and Token balances) will never be lost, corrupted, or deleted due to technical issues, server failures, or other events.

You acknowledge that:

• Uploaded images and other User Content used for AI Features may be stored for a limited period and then deleted;
• Generated Content may be stored without a fixed time limit but can be lost due to technical problems or maintenance;
• The Company is not liable for any loss of content or Tokens arising from such issues, to the maximum extent permitted by law.

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if:

• you violate these Terms or applicable law;
• we are required to do so by law;
• we decide to discontinue the App.

Upon termination, your right to use the App will immediately cease. We are not obligated to provide any refund or compensation for unused Tokens, remaining subscription time, or lost content, unless required by applicable law or app store policy.

13. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you within the App or via the app store listing. Your continued use of the App after the updated Terms become effective means you accept the changes.

14. Governing Law

These Terms are governed by and shall be construed in accordance with the laws of Georgia, without regard to its conflict of law provisions. Where permitted by law, you agree that any disputes arising out of or relating to the App or these Terms shall be subject to the exclusive jurisdiction of the competent courts of Georgia.
